This course provides a discussion on the meaning of ADR and briefly explore its features, types, and on the enforceability aspect of ADR being a pre-determined agreement to resolve dispute out of court. The course will focus discussion on the legal framework of Mediation and Arbitration in Malaysia. These methods of ADR are becoming increasingly popular mechanisms to resolve disputes. Many perceive litigation as time-consuming and believe that these methods of ADR would save time and costs, can resolve their disputes in confidence and also will not create ill-will or animosity as it sometimes does, in litigation. However, it is a misconception to think that arbitration in particular, is less expensive than litigation. As settlement of civil and commercial disputes through litigation has become very costly and tedious, the modern world is heavily leaning towards mediation and arbitration because of their comparative cost efficiency and simplicity. The other topics covered include online ADR and Islamic ADR. Both topics are relevant in addressing online transaction disputes and alternative dispute by way of Islamic methods. Students will be introduced with the necessary and required skills in managing ADR as legal practitioners.
