The growth of administrative law has been the direct result of the growth of administrative functions and powers. When extensive powers are conferred on the administration, an adequate control-mechanism is needed to ensure the administrative organs do not abuse their powers. This course covers the legal principles of administrative law such as the rule of law, subsidiary legislation, separation of powers, tribunals, discretionary power, natural justice and ombudsman. In addition to this, discussions include the remedial aspects provided for the aggrieved parties and the development and growth of administrative law, its scope and their relationship with the principles of constitutional law.

The course of Criminal Procedure I is designed to acquaint students with the fundamental constitutional rules that govern the criminal justice process. It is part of adjective law which provides for the process within which the principles of criminal law operate. The main objective of criminal procedure is to provide the rules, practices and procedures to ensure a proper and efficient administration of criminal justice. This course will discuss from the stage of arrest up to prosecution. Student will be introduced to the jurisdiction of courts as well as the procedure that should be adhered to and this will also include the topics of juvenile court. Focus will also be given on the area of power of arrest, investigation, power of public prosecutor and prosecution which involves the public prosecutor and the police. Other topics such as preliminary inquiry and transfer of cases will also be discussed.

The course further touches on the topic of natural law, philosophy of the theory of law, etc. Apart from that, the course will also discuss the theory of law which includes the relationship between law, morality and justice. The relationship between law and society will also be included in the discussion as well as the discussion of the philosophy of Islamic Jurisprudence.

This course will be divided into two parts. Part one discusses on the substantive laws of inheritance governing the Muslim succession and Non-Muslim succession. The discussion on the Muslim succession which includes Wasiyyah, Hibah, Fara'id and Waqf. Meanwhile discussion on the Non-Muslim succession involves the testate namely testamentary document and intestate succession namely the distribution principles. Part two discusses on the legal framework of the estate administration and procedural aspect of probate and succession in three different administrative bodies which are the High Court, Estate Distribution Division and Public Trust Corporation.

This course provides a discussion on the meaning of ADR and briefly explore its features, types, and on the enforceability aspect of ADR being a pre-determined agreement to resolve dispute out of court. The course will focus discussion on the legal framework of Mediation and Arbitration in Malaysia. These methods of ADR are becoming increasingly popular mechanisms to resolve disputes. Many perceive litigation as time-consuming and believe that these methods of ADR would save time and costs, can resolve their disputes in confidence and also will not create ill-will or animosity as it sometimes does, in litigation. However, it is a misconception to think that arbitration in particular, is less expensive than litigation. As settlement of civil and commercial disputes through litigation has become very costly and tedious, the modern world is heavily leaning towards mediation and arbitration because of their comparative cost efficiency and simplicity. The other topics covered include online ADR and Islamic ADR. Both topics are relevant in addressing online transaction disputes and alternative dispute by way of Islamic methods. Students will be introduced with the necessary and required skills in managing ADR as legal practitioners.

Lawyers need to engage in ethical behavior because of the duties they owe to their clients and to the legal system. This course basically consists of an examination of the behavior and responsibilities of lawyers. It provides students with an introductory exposure to ethical and moral issues of the legal profession in Malaysia. Topics will include the concepts and basic theories of ethics, legal education and bar admission, advocates role, the adversary system, the fiduciary responsibility to clients, conflict of interest, the regulation of the profession and ethical dilemmas in civil, criminal and public interest representation. Students will also be exposed to the practical side of maintaining a legal office. The focus will include discussions on the general administrative issues, how to keep good client, gaining communication and interpersonal skills to handle employees, client and the people involved in the court system. In addition, students will be exposed to the specific responsibilities on account management. Sources of discussion will be mainly based on the provisions of the Legal Profession Act, 1976 and its relevant rules in addition to decided court cases.

This course aims to expose students to the basic and the scope of public administration. The course will introduce the theories, models and concepts relating to the field of public administration in particular those being adopted and practiced abroad. Public administration is closely related to other disciplines such as political science, economics and management. Thus, this course will also introduce several approaches in the study of other knowledge in relation to public administration. In addition, the process and political system, the structure and function of the institutions of government will be examined. The relationship between the government under the framework of federalism of Malaysia is important in laying the basic structure of public administration in Malaysia and this concept will also be discussed.
